The Insurance Council of Australia (ICA) has called for structural reforms to the Compensation Scheme of Last Resort (CSLR) to address growing funding pressures and enhance consumer protection.
This appeal comes in response to a Treasury consultation paper examining the role of professional indemnity insurance in compensation claims.

The CSLR is designed to provide compensation to consumers who have suffered financial losses due to the misconduct of financial service providers. However, the scheme is currently facing significant funding challenges, prompting the ICA to advocate for reforms that would ensure its long-term sustainability.

One of the key issues highlighted by the ICA is the inappropriate reliance on professional indemnity insurance to cover claims related to fraud, criminal conduct, or systemic failures. These categories account for a substantial portion of the claims entering the CSLR. The ICA argues that professional indemnity insurance is not designed to cover such risks, and expanding its scope to do so would lead to increased premiums without effectively addressing the root causes of the scheme's financial shortfall.

To place the CSLR on a more sustainable footing and better protect consumers, the ICA has identified three priority reforms:

  • Implementing measures to prevent misconduct and reduce the incidence of claims entering the CSLR.
  • Ensuring that the funding model for the CSLR is equitable and does not disproportionately burden certain sectors.
  • Enhancing transparency and accountability within the scheme to build trust and confidence among stakeholders.

These proposed reforms aim to create a more robust and fair compensation framework that effectively addresses consumer losses while maintaining the viability of the insurance industry.
